[Solved] General vs. Special Power of Attorney in Dubai – Which is Safer?

Hi everyone,

I need to give someone Power of Attorney in Dubai to handle a few different tasks while I’m overseas – things like managing my apartment rental, maybe paying some bills from my local bank account, and potentially dealing with my car registration renewal.

A friend suggested getting a General Power of Attorney (GPOA) would be simpler to cover all bases. However, I’m feeling quite hesitant about granting such wide-ranging authority. Is using a GPOA common or even advisable in Dubai for these kinds of tasks?

What are the real risks associated with a General POA versus using a more specific or Limited/Special POA? Is it much safer to get a Special POA even if it only covers certain things? I want to ensure things are handled correctly but also want to protect myself. Any insights or experiences would be helpful!

Thanks!

Hello,

That’s an excellent and very important question. Choosing the right type of Power of Attorney is crucial for both functionality and security, especially when you’re managing affairs from abroad. We at POAPRO Dubai Power of Attorney specialize in drafting POAs in Dubai and can offer some clarity.

General POA vs. Special POA in Dubai:

  • General Power of Attorney (GPOA): Grants extremely broad powers to your agent (attorney-in-fact). They can potentially act on your behalf in almost any legal or financial matter – managing all bank accounts, buying/selling property, managing businesses, representing you in legal cases, etc., unless specifically restricted (which is complex to do comprehensively in a GPOA).
  • Special Power of Attorney (SPOA) / Limited POA: This is tailored to specific tasks or areas. You grant authority only for the powers explicitly listed in the document. For example, you can have an SPOA just for property management, another just for handling specific bank account transactions, or one just for vehicle-related matters.

Risks of a General POA:

While potentially convenient, a GPOA carries significant risks:

  1. Abuse of Power: The broad authority makes it easier for an agent (even a trusted one) to potentially misuse the powers, intentionally or unintentionally, leading to financial loss or legal complications for you.
  2. Lack of Control: You have minimal control once broad powers are granted.
  3. Difficulty in Oversight: Tracking all actions taken under a GPOA can be challenging.
  4. Acceptance Issues: Sometimes, specific institutions (like banks or government departments) may prefer or even require an SPOA detailing the exact power needed, rather than accepting a vague GPOA for specific high-risk transactions.

Recommendation:

For situations like yours, involving distinct tasks (property management, specific bill payments, car registration), we strongly recommend using Special Powers of Attorney (SPOAs).

  • You can issue one SPOA specifically for property management outlining all related tasks (leasing, rent collection, maintenance, Ejari, etc.).
  • You could issue a separate, very carefully drafted SPOA for limited bank account access (ideally a dedicated account just for property income/expenses) specifying only bill payment functions.
  • Another SPOA could cover only the vehicle registration tasks.

While it might seem like more documents, this approach provides significantly better security and control, limiting your agent’s authority strictly to the intended tasks.
